Terms & Conditions — Delivery Partners

These Terms & Conditions ("Terms") govern your participation as a delivery partner ("Delivery Partner", "you") on the Gujarat Delivery Service ("GDS", "we", "us", "our") Platform. By registering as a Delivery Partner, you agree to be bound by these Terms.

1. Nature of Relationship

You acknowledge and agree that:

You are an independent contractor, and not an employee, agent, or representative of GDS.

Nothing in these Terms creates an employer-employee relationship, partnership, or joint venture between you and GDS.

You are free to choose when you go online/offline on the app, subject to the operational requirements below.

2. Eligibility & Onboarding

You must be at least 18 years old.

You must provide accurate and valid identity, address, and (where applicable) vehicle documents for verification before onboarding.

GDS reserves the right to reject or suspend any application that does not meet its verification or eligibility criteria.

3. Your Responsibilities

As a Delivery Partner, you agree to:

Collect orders from the Restaurant Partner and deliver them to the Customer's specified address in good condition and within a reasonable time

Maintain a valid vehicle (where applicable), driving licence, and comply with all applicable traffic and road safety laws

Handle food items hygienically and avoid tampering with order contents/packaging

Behave professionally and courteously with Customers and Restaurant Partners

Keep your live location enabled while on-duty, so orders can be assigned and tracked accurately

4. Order Assignment & Acceptance

Orders are assigned based on your proximity and availability at the time.

Repeated unjustified rejection of assigned orders, or going offline immediately after accepting an order, may affect your ability to receive future orders and may result in suspension.

5. Payouts

Delivery Partners are paid on a daily payout basis.

Payouts are made directly by GDS via bank transfer or cash, and are processed outside of the Razorpay payment gateway (which is used only for customer-facing online payments).

Payout amounts are based on completed deliveries and any applicable incentive structure communicated to you separately via the app or in writing.

GDS reserves the right to withhold payout for a specific delivery pending investigation of a valid complaint, fraud, or dispute related to that delivery.

6. Suspension & Termination

GDS may suspend or terminate your access to the Platform, with or without notice, in cases including but not limited to:

Providing false information during onboarding

Repeated customer complaints, poor service quality, or safety violations

Fraudulent activity, theft, or tampering with orders

Abusive or unsafe behaviour toward Customers, Restaurant Partners, or GDS staff

Violation of these Terms

You may also choose to stop working with GDS at any time by discontinuing use of the app.

7. Liability

You are responsible for your own safety, vehicle, and compliance with traffic and road laws while on duty.

GDS is not liable for accidents, injuries, fines, or losses incurred by you while performing deliveries, except where required by applicable law.

You are responsible for any loss or damage to an order caused by your negligence and may be held liable to reimburse GDS or the affected party accordingly.

8. Taxes

You are responsible for any applicable income tax, GST (if applicable), or other statutory obligations arising from payouts received from GDS. GDS does not act as your employer for tax purposes.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of India, with courts at Gondal, Gujarat having exclusive jurisdiction over any disputes.

11. Changes to These Terms

GDS may revise these Terms from time to time, including to reflect expansion into new cities. Continued use of the Delivery Partner app after such changes constitutes your acceptance of the revised Terms.
